Contracts are concluded between the travel operator and the person acting on behalf of the group and as its representative rather than with every individual member of that group. If the group is a legal person, the legal person rather than the group leader shall be the travel operator's contract partner. The travel operator shall not negotiate with individual members of the group but with group leaders or agents only. Financial transactions shall also be conducted exclusively through group leaders or agents.
By making an application for a group booking with the help of the designated booking form, the applicant makes a binding offer for conclusion of a travel contract, with reference to the details stated in our quotation. If the applicant is underage at the time when the booking is made, the signature of a parent or legal guardian is required. The contract will not become effective until written confirmation of the booking has been issued. If the content of the confirmation deviates from that of the group booking, the confirmation is to be considered a offer of a contract to which Thomas Grether-Reisen GmbH shall be bound for a period of 10 days. Upon receipt of our confirmation the applicant will be provided with a risk coverage certificate (Sicherungsschein) pursuant to Article 651 section k of the German Civil Code (§ 651k BGB) at which time a down-payment of 10% per person of every individual traveller's share of the total price will be payable, to which a one-off booking fee of € 25,00 per group is added. The remaining sum is to be paid after receipt of the travel documents and no later than four weeks before commencement of travel and without further notice by Thomas Greuther-Reisen GmbH.
Groups may cancel their bookings at any time prior to commencement of travel. We urgently recommend that any cancellations be made in writing. If a group decides to cancel in whole or in part for reasons outside the travel operator's responsibility, the following cancellation fees apply.

23-16 weeks before commencement of travel:
50 % of the total price for the whole group or per individual booking
15-08 weeks before the commencement of travel:
70 % of the total price for the whole group or per individual booking
07-05 weeks before commencement of travel:
80 % of the total price for the whole group or per individual booking
04-00 weeks before commencement of travel:
95 % of the total price for the whole group or per individual booking
Cancellation fees are calculated on the basis of the minimum price per group stated in the confirmation letter. Groups shall be at liberty to prove that the loss effectively incurred is lower or that no loss has been incurred at all.
If the group which has cancelled the booking offers a replacement group, only a € 50,00 fee for the change of booking will be charged. If such an alteration leads to changes in the number of travellers or in the age structure, any additional services necessary will be invoiced subsequently. In case the replacement group opts for a shorter stay than the one originally booked, cancellation fees for any cancelled days of travel shall be levied from the person who originally booked the journey. The travel operator may object to any suggested replacements regarding individual travellers as well as entire new groups if these are incompatible with the particular requirements of the journey or if legal provisions preclude their participating in the journey. Any additional cost incurred on account of participation of third persons acting as replacements will be at the expense of the customer. We are authorised to invoice any additional loss incurred if proof of such loss can be given.
Within our general duty to exercise diligence we assume liability for due diligence in preparing the journey, careful selection of accommodation and accuracy of description of destinations listed in our catalogue. For any fault on part of our service providers or any damage to the traveller caused through neither gross negligence nor intent, the travel operator's liability is limited to a sum of three times the travel price, except for cases where bodily harm is concerned. Justified complaints are to be reported to ourselves or our service providers without delay, in order for us to be able to remedy the problem. Customers are obliged to cooperate to remedy disruptions and to help minimise any ensuing damage. Before terminating the travel contract (Article 651, section e, German Civil Code or §651e BGB) a deadline for remedial action by the travel operator is to be fixed, unless remedial action is impossible or is being refused by the travel operator or if immediate termination of the contract is justified on account of the particular interests of the traveller. Liability of the travel operator is excluded or limited in so far as liability of the service provider is also excluded or limited on account of official or legal provisions. By concluding a travel contract in accordance with Article 651, section m, 2 of the German Civil Code (§ 651 m, Satz 2, BGB) the parties agree on a period of limitation of one year. Any claims for compensation must be made to the travel operator within one month after the end date of the return journey as indicated in the contract. We urgently recommend that all claims be made in writing. Travellers are responsible for complying with all relevant rules and regulations for travel in the destination country.
The person making the booking commits himself/herself to provide Thomas Grether-Reisen with a preliminary, complete list of all persons occupying the accommodation in question no later than four weeks before the beginning of the journey. A final list of all persons occupying the accommodation in question, also including any short-term guests, must be sent to Thomas Grether-Reisen before the commencement of travel. Travel may be refused to any persons not registered as group members with Thomas Grether-Reisen and for whom no payment of the applicable price has been received prior to the commencement of travel. Calculation of the total price is based on the number of participants as stated before the commencement of travel. The group is responsible for complying with the house rules (in particular: quite hours, daily cleaning of the house). The rooms and inventories set out in the description shall be at the traveller's disposal for careful and responsible use within the meaning of the contract and its ancillary provisions. Any damage caused by the traveller will be at the traveller's expense and is to be settled directly with the caretaker. All houses are checked upon or after departure of each group. As a rule, furniture (beds, wardrobes etc.) may not be moved. Any additional charges not expressly mentioned in the confirmation letter are to be settled directly with the caretaker. Written approval by Thomas Grether-Reisen GmbH is required if you wish to bring pets.
Cleaning lies within the responsibility of the group occupying the rental property. Cleaning is to be done thoroughly in order to leave the house in clean and tidy condition for the next group, even if final cleaning services are paid for separately or included in the price. The group shall be responsible for final cleaning unless expressly stated otherwise. Groups are to make sure they allow enough time for cleaning on the day of departure. In case cleanliness of the property is found to be insufficient on the day of departure, the group may be invoiced for any additional cleaning services necessary. Properties offering board for groups of children and young people routinely require travellers to make their beds and to help in the serving and preparation of meals.
Our prices are based on the minimum number of occupants indicated next to the price. Prices are calculated on the basis of the minimum number of occupants even if the actual number of participants is lower. Thomas Grether-Reisen GmbH has the right to change indicated and confirmed prices if prices charged by service providers have verifiably and unexpectedly increased and if the period between conclusion of the contract and scheduled arrival date exceeds four months and if the customer is informed about the price increase no later than four weeks before the commencement of travel. In case of price increases exceeding 5 % or of considerable changes in essential parts of the travel services provided, the traveller may cancel the contract. The traveller may then demand participation in another journey of at least the same value, if the travel operator is able to offer such a journey to the traveller from his range of services without additional charges - the same applies to cases of cancellation on part of the travel operator. Travellers must make their claims to the travel operator without delay after they have been notified. Any oral ancillary agreements must be confirmed in writing in order to be legally effective. Invalidity of individual provisions of this contract or of the terms and conditions of travel is without prejudice to the contract and the terms and conditions as a whole. The agreed place of jurisdiction shall be Karlsruhe, Germany, in so far as legally admissible.
